Terms of Service

1. Agreement

These Terms govern your use of abacarenetwork.com, operated by ABA Care Network™ ("we," "us"). By using the site or submitting a match request, you agree to these Terms. If you do not agree, do not use the site.

You must be at least 18 years old and legally able to enter a contract. The site is intended for parents, guardians, and adult caregivers.

If you use the site or submit a request on behalf of another person — such as your child — you represent that you are authorized to act for that person and to accept these Terms on their behalf.

2. What we do — and what we do not do

We operate a directory and referral service that connects families with providers of Applied Behavior Analysis therapy.

We are not a healthcare provider. We do not:

• Provide ABA therapy or any other clinical service
• Diagnose, assess, or treat autism or any other condition
• Give medical, clinical, behavioral, educational, or legal advice
• Employ, supervise, direct, or control the providers in our directory

Any relationship you form with a provider is solely between you and that provider. We are not a party to it.

3. No verification or endorsement of providers

We compile directory listings from public sources — including the federal NPPES/NPI Registry, the BACB certificant registry, state licensing boards, and provider-submitted information — and pair them with independent family reviews where available. We make reasonable efforts to keep listings accurate, but we do not independently verify the credentials, licensure, certification status, insurance participation, background, competence, safety practices, or quality of care of any provider listed. Inclusion in our directory is not an endorsement, recommendation, or guarantee.

You are responsible for evaluating any provider before engaging them, including verifying BCBA or other certification through the Behavior Analyst Certification Board and any applicable state licensing board, confirming insurance and licensure, checking references, and satisfying yourself as to their suitability for your family.

Any ratings, scores, "best match" orderings, badges, and similar signals we display are statements of opinion based on the data available to us — not statements of fact, endorsements, or guarantees. Our listings and verification indicators are provided for families' general information only; they are not primary-source credential verification, and they may not be used or relied on by any employer, payer, or credentialing organization to verify a provider's credentials.

If in the future any placement in search results, ranking, or matching is influenced by payment from providers, that will be disclosed clearly and conspicuously on the results page itself and in this section. As of the last-updated date above, no such paid-placement arrangement is in effect.

4. Matching service

When you submit a match request, you authorize us to share the contact and search information you provide (including location, insurance, availability, your child's age range, and diagnosis status) with the ABA provider(s) your request identifies. Those providers may contact you directly by email, phone, or text.

Care advisor follow-up. A care advisor may follow up with you by call, text, or email about your request — including to check whether a provider responded and to suggest alternatives. This follow-up is part of the matching service. You can stop it at any time.

Our own services. ABA Care Network may itself offer, or arrange through affiliated providers, ABA services (for example, in-home ABA in select areas). If a care advisor or the site suggests a service we operate or are affiliated with, we will identify it as ours at the time of the suggestion. You are never required to use our services, and directory listings and search results are not skewed toward them.

Referral compensation. As of the last-updated date above, providers do not pay us for connections or referrals. If we later accept fees from providers for connections, we will disclose that in this section and in the connection flow itself.

We do not guarantee that you will be matched, that any provider will respond, that any provider will have availability, that any provider will accept your insurance, or that any match will be appropriate for your family's needs.

Do not submit clinical information. Our intake does not request diagnoses, evaluations, medical records, or treatment history, and you should not include them in free-text fields or attachments.

5. No emergency services

Our site is not for emergencies. If you or someone else is in immediate danger or experiencing a crisis, call 911 or go to the nearest emergency room. In the United States you can also call or text 988 to reach the Suicide and Crisis Lifeline. Do not use our matching service to seek urgent or emergency help.

6. Your responsibilities

You agree to provide accurate information, to use the site only for lawful purposes, and not to:

• Submit another person's information without authority to do so
• Scrape, crawl, harvest, bulk-download, or systematically extract directory listings or other site data, or otherwise exceed the license granted in Section 8
• Use the site to send unsolicited commercial messages to providers
• Interfere with the site's operation or security
• Misrepresent your identity or your relationship to the person seeking services

7. Provider listings, claims, and user submissions

Providers may claim, correct, update, or request removal of their listing through the process described on our corrections and takedown page. Providers are responsible for the accuracy of information they submit or approve, for their own advertising and licensing compliance, and for any legal or regulatory obligations that apply to their practice (including HIPAA where applicable). We may remove, edit, or refuse listings at our discretion, subject to applicable law.

Reviews and other submissions. If you submit a review, waitlist report, question, article, comment, or other content, you grant us a worldwide, royalty-free, sublicensable license to host, display, reproduce, adapt (for formatting and moderation), and distribute it in connection with the site and our services. You keep ownership of your content — this is a license, not a transfer.

You represent that anything you submit: is truthful and based on your genuine experience; does not contain another person's private information (including any child's name or identifying details); is not defamatory, harassing, discriminatory, or unlawful; does not infringe anyone's copyright, trademark, or other rights; and was not paid for, or submitted by or on behalf of a provider, without disclosure. We may moderate, decline, edit for format, or remove any submission at our discretion, and we may share a submission with the provider it concerns. Published reviews reflect their authors' opinions, not ours. To report an infringing or unlawful submission, email [email protected] with a description of the content, where it appears, and the basis of your objection.

8. Intellectual property, limited license, and automated access

The site — including its design, text, software, and our selection, arrangement, enrichment, and presentation of directory data (such as verification records, availability information, insurance-participation mapping, and review content) — is owned by us or our licensors and protected by copyright (including compilation copyright), trade-secret, and other intellectual-property laws. We claim no rights in unaltered government data; our rights cover the original selection, coordination, arrangement, verification, and enrichment that make up this site.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the site for personal, non-commercial purposes. All rights not expressly granted are reserved; there are no implied licenses.

Prohibited uses. Except as expressly permitted below, you may not, directly or indirectly: scrape, crawl, harvest, spider, or use any automated means to extract site data in bulk; reproduce, compile, mirror, frame, or redistribute listings or any substantial portion of the site's data; use site data to build, populate, train, or improve any competing directory, dataset, product, or machine-learning model; or probe, circumvent, or defeat any rate limit or technical protection measure.

Welcome uses. We support search engines and AI assistants that help families find care. Indexing the site, quoting or citing site content with attribution and a link to the source page, and answering an individual user's question using our pages are expressly permitted. What is not permitted is bulk replication — extracting or using our data at a scale, or in a manner, that substitutes for the site itself.

You agree that a violation of this section would cause us irreparable harm for which money damages are an inadequate remedy, and that we are entitled to seek injunctive relief in any court of competent jurisdiction, in addition to all other remedies. Provider names and marks belong to their owners.

9. Third-party links

Our site links to provider websites and other third-party resources. We do not control them and are not responsible for their content, practices, or privacy policies.

10. Disclaimer of warranties

THE SITE AND MATCHING SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT INFORMATION IN LISTINGS IS ACCURATE OR CURRENT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM THE ACTS OR OMISSIONS OF ANY PROVIDER, INCLUDING THE QUALITY, SAFETY, OR OUTCOME OF ANY SERVICES YOU RECEIVE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow these limitations, so they may not apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the site, your violation of these Terms, or your interactions with any provider.

13. Binding arbitration and class-action waiver

Please read this section carefully. It affects your legal rights and requires you to resolve most disputes with us in binding, individual arbitration.

Agreement to arbitrate. You and ABA Care Network™ agree that any dispute, claim, or controversy arising out of or relating to these Terms, the site, our matching service, or any interaction with us (a "Dispute") — other than the small-claims and equitable-relief carve-outs below — will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The Federal Arbitration Act governs this section. The arbitration will be conducted by a single neutral arbitrator, will take place in Delaware or by remote proceeding at the consumer's election, and will apply the substantive law described in Section 14.

Class-action and mass-arbitration waiver. Any Dispute must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, coordinated, mass, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this waiver is found unenforceable as to any claim, that claim (and only that claim) will be severed and litigated in the courts identified in Section 14, and the remaining claims will proceed in arbitration.

Small-claims and equitable-relief carve-outs. Either party may bring an individual action in a small-claims court that has jurisdiction, and either party may seek injunctive or other equitable relief in court to protect intellectual property, confidentiality, or security. Nothing in this section prevents you from filing a complaint with any government agency.

Notice of Dispute. Before initiating arbitration, the party bringing a Dispute must send the other a written Notice of Dispute describing the claim and the relief sought. Send a Notice of Dispute to us at [email protected]. If the Dispute is not resolved within 60 days, either party may commence arbitration.

Fees. The AAA Consumer Arbitration Rules govern the allocation of filing, administrative, and arbitrator fees. Where those rules require us to pay your share, we will do so. Each party otherwise bears its own attorneys' fees except as required by law or awarded by the arbitrator.

30-day right to opt out of arbitration. You may opt out of this arbitration agreement and class-action waiver by emailing [email protected] within 30 days of first accepting these Terms with a subject line of "Arbitration Opt-Out" and including your full name and the email address you use with the site. Opting out will not affect any other provision of these Terms.

Changes. If we materially change this Section 13, the change will apply only prospectively to Disputes arising after the change takes effect, unless you agree otherwise.

14. Governing law and venue

These Terms and any Dispute are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Subject to Section 13, the exclusive venue for any court action permitted by these Terms is the state and federal courts located in Delaware, and you consent to personal jurisdiction there.

15. Changes to these Terms

We may update these Terms. Material changes will be posted here with a new "Last updated" date and, where feasible, a notice on the site. Continued use after changes take effect constitutes acceptance, except for changes to Section 13 which apply prospectively as described in that section.

If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remainder stays in effect. Sections 3, 4, and 7 through 14 survive any termination of these Terms or of your use of the site. These Terms are the entire agreement between you and us regarding the site, and our failure to enforce any provision is not a waiver of it.
